Terms & Conditions
Overview
By booking services or purchasing artwork, you agree to the following terms and conditions. These terms are designed to ensure clarity, fairness, and a positive experience for both the artist and the client. Please read them carefully before booking.
Booking & Retainer
A signed agreement and a non-refundable retainer are required to reserve your wedding or event date. Dates are not considered booked until both are received. The remaining balance is due according to the timeline outlined in your agreement.
Services Provided
Services may include live wedding painting, live guest portraits, and/or custom art commissions, depending on the package selected. The artist will use professional judgment to create artwork in their established style, focusing on capturing the atmosphere, emotion, and overall experience of the event rather than exact photographic realism.
Artistic Style & Creative Process
All artwork is created in the artist’s signature impressionistic style. By booking, the client acknowledges familiarity with the artist’s portfolio and understands that artistic interpretation, color palette, and composition are at the discretion of the artist. Minor artistic variations are a natural part of hand-painted work.
Event Conditions
The client agrees to provide a suitable workspace at the event, including adequate lighting and a safe, weather-appropriate environment. For outdoor events, reasonable protection from extreme weather conditions (rain, wind, excessive heat, or cold) is required to ensure the quality and safety of the artwork and materials.
Timeline & Completion
Live wedding paintings and guest portraits are created during the event, with final refinements completed after the event if necessary. Completion timelines for final artwork will be discussed in advance and may vary based on the scope of the project and event conditions.
Travel
The artist is based in Colorado and travels throughout the United States. Travel fees, if applicable, will be outlined in your agreement. Clients are responsible for providing accurate event location details in advance.
Cancellations & Rescheduling
The retainer is non-refundable. If the event is canceled or rescheduled, the artist will make reasonable efforts to accommodate a new date, subject to availability. If the artist is unavailable for the new date, payments made beyond the retainer may be handled according to the terms outlined in your agreement.
Client Responsibilities
Clients agree to communicate all relevant event details in a timely manner, including timelines, venue logistics, and any special requests. Delays or changes communicated late may impact the scope or completion of services.
Copyright & Usage
The artist retains the copyright to all artwork created. The client receives full personal-use rights to display the artwork in their home or gift it to others. The artist reserves the right to use images of the artwork for portfolio, website, social media, and promotional purposes unless otherwise agreed upon in writing.
Care of Artwork
Once the artwork is delivered, the artist is not responsible for damage caused by improper handling, display conditions, or environmental factors. Care instructions will be provided when applicable.
Limitation of Liability
The artist is not liable for circumstances beyond reasonable control, including but not limited to extreme weather, venue restrictions, illness, or unforeseen event disruptions. In such cases, reasonable efforts will be made to provide an alternative solution when possible.
Acceptance of Terms
By booking services or purchasing artwork, the client acknowledges that they have read, understood, and agreed to these terms and conditions.
